Dear DM3 Homeowners,

There have been new developments concerning our HOA that you need to know about.

Recently, the Arizona Supreme Court made a ruling about how CC&Rs in Arizona HOA’s could be legally amended. This prompted us to request an audit by the Audit Committee to verify the vote on our 2019 CC&R amendments to make sure they were valid. To be passed, the amendments had to carry a majority vote of the homeowners. (There are 223 lots in DM3, a majority would be 112 votes). In reviewing the Ballots, they discovered that there were only 84 yes votes and 11 no votes to amend the CC&Rs so the 2019 amendments are not valid.

We consulted our attorney to see how this situation could be remedied. She drafted a Notice of Erroneous Recordation of Declaration of Establishment of Conditions and Restrictions for Green Valley Desert Meadows No. 3 (Revised 2019) and recorded it with the state so we would be in compliance.

This means that since our 2019 CC&Rs are not valid, we fall back to our 2006 CC&Rs which were legally voted in. The 2019 CC&Rs have been replaced by the 2006 CC&Rs on our website, www.desertmeadows3.com. They can be read and/or printed off from the website. If you don’t have the ability to print them off you can request a hard copy from the secretary, Debra Woolley via email at secretary@desertmeadows3.com or phone 360-601-2018.

The CC&R Revisions Committee will be working with the 2006 CC&Rs to explore if and how they can be improved and updated.

Our next Board meeting is Wed., August 17th, at 3:00pm at Abrego South. The Announcement and Agenda for the meeting will be emailed next week.

Greetings Fellow Homeowners!

For your reading enjoyment, the Unapproved Minutes of our recent May 18, 2022 Board meeting are posted on the website, desertmeadows3.com.

During the meeting several points were discussed by the Board and the Members present which, we agreed, should be shared.

The unlawful feeding of wildlife is a petty offense in Arizona. This does not include tree squirrels and birds. However, at least 2 Homeowners reported expensive repairs needed from roof damage by Ravens. Ravens are territorial birds and will hang around for an easy meal. We request that you don’t attract the Ravens by feeding them. Hopefully, they will get discouraged and move on to find their own sources of food, which are abundant because they will eat almost anything.

CC&R 7.A. states that “Trash containers shall be enclosed by an approved wall, or other structure when not placed out for pickup”. After much discussion amongst the Board and Members present, the Board agreed that since many homes were built without garages, it would be acceptable to store the trash container up by the house under the carport, as long as, it was neatly kept. This also aids the Homeowner in moving the container back and forth on pickup day.

Members brought to the attention of the Board a Homeowner on S. San Ray that is in perceived violation of CC&Rs, and they have witnessed dangerous and illegal activity. 911 was called and the Sheriff’s Deputies responded and are aware of the illegal activity. Their advice to all Homeowners is this: “If you witness dangerous or illegal activity, call 911. Do not be confrontational.” CC&R violations will be addressed by the Board, but illegal activity – call 911.

The AZ Supreme Court recently handed down a ruling that affects HOA CC&Rs. The CC&R Revisions committee will be meeting again soon. If you would like to be a part of this process, please join us.

Nominations are now closed for our 2022 election. There were five (5) Board openings and there are five (5) Homeowners who have submitted their names and bios for candidacy which can be found in the Nominations Committee Report on our website. Ballots will be mailed out December 30, 2021 and due back (postmarked by) February 1, 2022. The election results will be announced at the Annual Meeting on February 16, 2022. 

 

And from our Social Committee:

 

The next HOA Social will be a Winter Potluck, Saturday, December 11th from 4:00 pm to 6:00 pm at Abrego South. Do you have a favorite salad, casserole, dessert or any special food that you really like?  Bring a dish to share and discover if others also like it.  Remember to bring a serving utensil for it.

 

The social committee will have coffee and water.  If you prefer a different beverage, please bring it with you.  Everyone please bring your own silverware.  Paper plates will be available for those who do not bring their own plate.

 

This is an opportunity to meet other homeowners and have good food.  Looking forward to seeing YOU there.

My name is Georgette Lauzon and I am submitting my name as a candidate for DMIII Board.  I feel I would be an asset to DMIII as I have been involved with the board for the last 7 years, I have followed the meetings since 2011, when I moved here to DMIII, so therefore I have seen many changes in DMIII.

Resident of DMIII since 2006, previous board member, Architectural Chair and current interim board member.  I have tried to keep the board on an even keel for the past three years and i wish to continue that effort.  Resident of Arizona for over 20 years and retired special education teacher in Nogales, Az.   I want to continue to assist in maintaining a legal and common-sense approach to our board activities.  We have a lot of work to complete in upgrading our CC&R’s to meet legal requirements for Arizona HOA’s.

I am currently serving on the HOA Board as Secretary having been appointed when there was a gap to fill after the last election.  I have 34 years of experience owning and running a business and serving as Secretary on that Corporate Board, as well as, previously serving as Secretary on an HOA Board in WA state before my husband and I relocated here in April of 2019.  I am choosing to run for an actual 3-year term because I feel that there is work to be done.   In addition to maintaining the HOA records, there is the matter of our By-Laws and CC&Rs.   Many of them are outdated, poorly worded, and contradictory.   With proper Attorney input we can get this HOA back on solid footing which will aid in protecting our 55+ community status and our property values.   I don’t believe in strong arm tactics.   I believe a community grows strong through a spirit of cooperation, goodwill, and cohesiveness.

Tom Marek.  Nov. 30, 2021

Hello.  My name is Tom Marek.  My wife and I have been residents of Desert Meadows III since April, 2015, and homeowners here since January, 2017.  (We were renting and bought the house from the landlord.)  I helped with the audit in November, 2020, and we agreed with the recall election this past spring.  When the previous Treasurer resigned last spring, I stepped in and filled the Treasurer position by appointment.  Knowing the value of a more permanent Board and position, I now wish to be elected to the Board and Treasurer for a 3-year term. Thank you for considering me. 

 

Marsha Eades.  Nov. 30, 2021

 

We moved to Green Valley in 2012 from the beautiful Olympic Península in Washington State.  I worked in a construction office, doing estimates, invoicing, payroll and taxes.  We did foster care and had a juvenile detention home working with the Juvenile court system.   In the last 3 years, I have been actively working as a real estate agent.  As the HOA secretary I worked with several of our members to set up a computer with our files, building on all of the work that our past President Cathy Tewksbury had done scanning boxes of old files.  I enjoy seeing this current board functioning and working together in a friendly, business, neighborly way, and many of us have a desire to see this continue.

2022 Nominations

To: Desert Meadows III Homeowners

From: Your Nominations Committee (Mike Norman, Joan Walker, and Anne Reid)

Greetings! It’s time to think about our 2022 Elections. There will be five (5) openings on the Board for 2022. Last year only two of the Board members, Bill Mulesky, who is currently serving as President, and Mike Norman, who is currently serving as Nominations Chair, were actually elected by the membership for a three (3) year term as directors.

The other five (5) positions (Randy Drenning-currently Vice President, Debra Woolley-currently Secretary, Tom Marek-currently Treasurer, Hugh Cox-currently Grounds Chair, and Johnnie Powell-currently Member at Large, also on Grounds Committee) were appointed for a one (1) year term as directors or until the next election. Some of these appointees might also run in this election.

As long as you are a member in good standing, meaning your HOA dues are current, you are eligible to run for a position on the Board. Submitting a short biography and/or reason you would like to serve is not required but is strongly suggested because it is a way of letting the voting members know who you are.

Just because there are only five (5) openings doesn’t mean we will only accept five (5) submissions. All eligible Members who submit a request to serve on the Board will be placed on the Ballot. The five (5) Members receiving the most votes in the election will be elected to the Board. After those Members are elected to the Board, an Organizational meeting is held in which Bill Mulesky and Mike Norman (currently on the Board) and the five (5) new Board members decide which Member will serve in which Board and/or Officer position. If not enough community members run for a Board position and there are still openings after the election, the Board will have to find members to appoint to positions as they did this past year.

You can email your submissions to nominations@desertmeadows3.com or snail mail them to Desert Meadows III, Inc. HOA, PO Box 271, Green Valley, AZ 85622. You may also hand deliver them to Mike Norman, Chair of Nominations, at our next Board meeting on Wednesday, November 17th, at 3pm at Abrego South.

Submissions must be received by December 1, 2021 to make it onto the Ballot.

Our HOA owns no common property. Everyone is responsible for maintenance on their own lots and homes. However, Desert Meadows 3 is a non-profit corporation with Articles of Incorporation, By-Laws, and CC&Rs as our governing documents. One purpose of the documents was to establish a 55+ community. Another purpose, through our CC&Rs, is to maintain our property values.

Since we are a 55+ community, we must adhere to our governing documents to maintain that status.

None of this work gets done by itself. It takes volunteers, like yourselves, from this community, willing to donate a bit of your time and talent.

Serving on your HOA Board of Directors and Committees is a wonderful opportunity to get involved and contribute to your community. We look forward to receiving your submissions.

Message from Grounds & Weeds:

Rain is coming and so are the weeds! If you don’t mind using a chemical weed preventer, you might consider spreading some Preen (available at True Value, Ace Hardware, etc.) or other brand of weed pre-emergent as soon as possible.
I like to rely on rain to get it into the ground, but you also can use a hose to soak it in. It won’t prevent every weed, but it can make a big difference — as many of you already know.

Coronavirus Info from GVC Council

Dear Community Member: 
Your Risk as the Coronavirus Careens Out-of-Control
Green Valley and Quail Creek are basically Senior communities. Therefore, most residents are very aware of their vulnerability to the Coronavirus. If we seniors are following the guidelines of wearing a mask, washing our hands and are not gathering in groups, then “risk” becomes the most vulnerable point in our protection. We all experience risk when we go shopping, pump gas, handle money, when a friend invites us to dinner, on and on and on. Everyone needs to consider how much risk they are willing to take. Because we live in a community of Seniors, we residents ought to be able to significantly reduce the spread of the virus in our community!


Pima County’s Voluntary Curfew
Pima County has recommended a voluntary curfew running from 10 PM to 5 AM. The curfew started on November 23, 2020 and will run through the end of December. For most of us in Green Valley this should not be a hardship as most of us are “early” to bed and “early” to rise. And though the sun has not yet risen, remember do not leave your house for your morning constitutional before 5:00 AM. For those of you who are planning to raise your glass one more time, remember you need to be sober to take yourself home by 10 PM. Although the curfew is voluntary, barring essential or emergency activities, if everyone practices social distancing by observing the curfew, then we can help reduce transmission of the coronavirus.


Pima County and Arizona Covid-19 Dashboard Statistics
In the last week of November, the total number of people in Arizona who have tested positive for Covid-19 is 325,995 and the number of deaths is 6,634. In Pima County, the number is 38,668 positive cases and 682 deaths. The death rates for the county and state are comparable, at .017 for Pima County and .020 for Arizona.


Free Covid-19 testing is available. “Pima County has opened sites offering free testing to anybody in the community, ages 5 and older, without a doctor’s order and even if you do not have symptoms. These sites offer the PCR test that can let you know if you have an active Covid-19 infection and may be able to spread the disease to others.” There are locations for both walk up and drive thru testing.

Desert Meadows III HOA Board Vacancy Notice OCTOBER, 2020

At the end of this year there will be four (4) vacancies for Directors.

Some of the vacancies will be Officer positions. In accordance with the HOA By-Laws, after the Director vacancies are filled, the Directors then vote for the Officer positions – President, Vice President, and Treasurer.

We are asking that any member who is interested in serving on the Board (including winter members) with or without experience in serving on Boards, to submit your name to the Nominating Committee by Email – gvdesertmeadows3@gmail.com, by October 15,2020.

The purpose of your HOA is to serve the members by maintaining and enforcing the CC&Rs & By-Laws which you approved, for maintaining our property values. All candidates should be in good standing with the HOA CC&Rs and By-Laws.

Please be a volunteer that will help your HOA and neighbors.
